1      Interpretations

    1. The Company’ is deemed to be ‘The Incredibly Sensible Greenhouse Company’ the address of which is at the top of this Terms & Conditions document and on ‘The Company’s’ website

 

    1. ‘The Purchaser’ is deemed to be the person(s) or Company who has placed an order for goods, paid an agreed deposit and received an Order Acknowledgement from ‘The Company’
    1. ‘The Goods’ include all products and services provided by ‘The Company’.

 

    1. The ‘Contract Of Sale’ is deemed to be an Order Acknowledgment issued by ‘The Company’ after receipt of an order from ‘The Purchaser’ and shall become effective only after receipt and acceptance of a monetary deposit payment by ‘The purchaser’ or his or her representative.
    1. The term ‘in writing’ shall  be deemed to be notification in writing either by letter or electronic mail (e.mail) from the ‘Purchaser’ or his/her representative to ‘The Company.

 

    1. Any reference in these Terms & Conditions of a Statute shall be construed as a reference to that provision, or as amended, re-enacted or extended.
    1. The headings in these Terms & conditions are for convenience and shall not affect their interpretation.

 

2    Consumer protection (Distance Selling) Regs.2000

 2.1   ‘The Purchaser’ is entitled to cancel his/her order within fourteen days ‘in writing’ from the date of
          the Order Acknowledgment for any reason with a reimbursement of all monies paid including any
         deposit.

2.2   ‘The Purchaser’ is further entitled to cancel the ‘Contract of Sale’ with ‘The Company’ ‘in writing’ up
         to seven days following date of delivery but in so doing ‘The Purchaser’ must take all
         reasonable care to ensure safe keeping and return (at cost to ’The Purchaser’)  of ‘The Goods’ to
        The Company’ in it’s original packaging, undamaged and in a saleable condition.   In the event of
        cancellation of ‘The Contract’ by ‘The Purchaser’  within the specified time without  ‘The  Goods’ 
        being returned within five days from the date of cancellation,  ‘The Company’ reserves the right to
        arrange collection and levy an appropriate charge for doing so.

2.3   As an exception to the above, it is a Condition of Sale that any order for a non-standard bespoke
        model Greenhouse or Orangerie whether in design or Colour cannot be cancelled after fourteen
        days from date of the Order Acknowledgment.

3    Orders and Specifications

    1. All orders submitted by ‘The Purchaser’ or his/her representative shall only be deemed to be

        accepted after the issue of an Order Acknowledgment and receipt of deposit payment by
        ‘The Company’

 

3.2   All orders for goods are subject to acceptance based on geographical location within Europe
 and mainland United Kingdom ‘The Company reserves the right to decline any order
 irrespective of any website automated response suggesting or implying acceptance.
 ‘The Company’ will notify ‘The Purchaser’ within forty-eight hours if an order has been declined.

    1.  The quantity and description of ‘The Goods’ as set out in the Order Acknowledgment will be

       adhered to and subject to change or alteration only after mutual agreement between ‘The
       Purchaser’ and ‘The Company’ providing also that any change or alteration is made at least seven
       days prior to delivery.  Any such changes will have been deemed to have been accepted after
       issue of either a revised or new Order Acknowledgment,  or confirmation by electronic mail (e.mail).

    1.  All Greenhouses and Orangeries are sold on a supply only basis unless otherwise stated.   An

       optional installation service is available at extra cost.

4    Pricing

    1.   All prices published by ‘The Company’ whether on the Company’s website, Brochure or other

  publications are offered as ‘An Invitation To Treat’ and become binding only after the
  issue of an Order Acknowledge by ‘The Company’.

    1.  The Company’ reserves the right to alter any published prices, withdraw  or alter any offers without

        notice.  This condition does not apply for orders already received and accepted by ‘The Company’.
      
5.  Delivery and acceptance of Goods

5.1  Delivery times and dates given are always approximate and offered as a guide only.   Delivery
       timescales are either historically based or as advised by the relevant manufacturer.  ’The Company’
       will not be liable  for any cost implications arising from delays howsoever caused by any third party
       or event not in the control of ‘The Company’ or which could not have been reasonably foreseen.

5.2  It is the responsibility of ‘The Purchaser’ to ensure that any missing packages are
recorded upon delivery and contents checked within seven days thereafter reporting any
missing  parts to ‘The Company’, the  exception being when installation is to be carried out by
or on behalf of ‘The Company’.  In these circumstances the fitters will be responsible for
checking and reporting any missing items.

 

5.3  The delivery address will be as agreed and shown on the Order Acknowledgment issued by
       ‘The Company’.  Any changes to this address must be notified and agreed prior to delivery.  If a
        failed delivery has occurred for any reason through no fault of the person making the delivery,
        the manufacturer or ‘The Company’ or the delivery is refused or diverted to another address,
        additional costs will be levied against      ‘The Purchaser’ for re-delivery as appropriate

5.4   In the unlikely event of goods being defective upon delivery, replacement will be made without
        delay or as soon as possible thereafter.  In the event of any defective parts being discovered
        during or after installation by ‘The Purchaser or his/her representative, ‘The Company’ will
        replace those items without delay or as soon as possible for self-assembly.  Where ’The Purchaser’
        has chosen the Optional Installation Service and defective parts are discovered or missing ‘The
        Company’ will replace and install as appropriate without delay or as soon as possible thereafter.

5.5   The risk of ‘The Goods’ pass onto the recipient upon delivery.

   Payment

6.1   Following receipt of an agreed deposit payable by ‘The Purchaser’ and shown on the Order
        Acknowledgment, the remaining amount representing full payment of ‘The Goods’ (except
        Installation charge if appropriate) shall become payable on notification of delivery.  Any deviation
        from these terms will result in delay or postponement of delivery.  Payment for installation
       (if appropriate) is to be received by ‘The Company’ on the same day as completion.

6.2  All goods remain the property of ‘The Company’ until full payment has been made.

7   Optional Installation

7.1  We reserve the right to use our own fitters or engage established experienced Greenhouse
       fitters to carry out installation of Greenhouses, Orangeries and other garden buildings.   ‘The
       Company’ will be responsible for work carried out by it’s own fitters and sub-contractors.

7.2  Installation of all garden buildings supplied and carried out by or on behalf of ‘The Company’ will
       only be carried out onto a customer supplied/prepared firm, flat and level site.   Building or altering
       of any wall or masonry is not included in the installation service.  Any building work should be
       carried out by a competent person to plans and dimensions supplied by ‘The Company’ prior to the  
       commencement of any work.  The ground inside and immediately surrounding the site should be
       flat and level (especially following any building work) without any obstructions that might cause
       injury to fitters or delay of installation.

7.3  The optional Installation Service does not include assembly or installation of Staging and
 Shelving (whether or not purchased as part of a package deal). These items are supplied flat-
 packed for self-assembly.  In the event of the installer being unable to commence or complete the
 installation of the greenhouse/Orangerie as a result of an inappropriate site (see 7.2 above), we
 reserve the right  to levy an additional cost at our discretion to cover lost time and/or travel.

 

    1. An agreed date for installation will be subject to weather conditions leading up to that date which may

      affect working  schedules and  prevailing weather conditions at the time.  ‘The Purchaser’ will be informed
      of any postponements or delays at the earliest opportunity. ‘The Company’ will not be liable for any
      financial loss as a result.

 

8     Warranties and Liability

8.1   All guarantees and warranties are offered on behalf of the relevant manufacturers

8.2  ‘The Company’ will not be liable for any defects arising from ‘fair wear and tear’ willful or
       accidental damage, negligence, use other than which the greenhouse or Orangerie has been
       designed, alteration without the knowledge and agreement of ‘The Company  or damage as a result
       of adverse weather conditions.

    1. By the very nature of design and construction of Greenhouses and Orangeries as external garden structures, such buildings are not considered or expected to be 100% wind, draught or leak proof in all conditions and therefore not included in any guarantee.
